AIC's approach appears to have ENGlobal provide the services via a series of task orders. Is it the intent of AIC to have a comprehensive EPC contract which includes a fixed price, guaranteed completion date ( through acceptance testing) with liquidated damages for delays, guaranteed performance that matches the financial model with liquidated damages for a shortfall in performance. 2. The warranty statement in the master agreement, states that EN Global only passes through vendor warranties. Is it the intent of AIC to have EN Global ( as EPC contractor) to be fully responsible for warranties. 3. In the master agreement information provided by AIC ( the work done by RDS and other information) is to be relied upon by EN Global. Is it the intent of AIC to have EN Global verify and take responsibility for the RDS design information? 4. During the procurement and construction phases of the project, are there going to be milestones that need to be achieved for both payment and to track progress? 5. Is the EPC agreement going to contain the following: retainage at 10 % of each payment, responsibility for risk of loss, timing of the transfer of care custody and control, EPC responsibility for acceptance testing, definitions of mechanical completion, substantial completion and final completion, warranties , punch list, etc. 6.
